Abstract

Abstract

Praise be to Allah, Lord of the worlds, and peace and blessings be upon Muhammad and upon his family and companions altogether. Financial transactions and banking affairs, especially in our beloved Iraq, have seen an increase in loans of various types and forms, and revenues have multiplied... among other financial and banking transactions, not to mention the abundance of government and private banks, and electronic payment offices (MasterCard - remittance offices...). Each of these aspects has been governed by Islamic law, which has established rules and a general system that ensures individual and societal reassurance and balance, guaranteeing the state a reduction in class disparities and preventing the accumulation of wealth in the hands of individuals, as well as avoiding plunging the state into outcomes that could negatively impact its financial rights. Scholars in the era of imitation focused on documenting the jurisprudential rules they extracted through their consideration of the fatwas and opinions of the imams of the schools of thought. They diligently worked on the branches and details of jurisprudence, collecting them under a comprehensive principle that encompasses all that falls under it from jurisprudential examples.
